What is the line between fair use and copyright infringement these days?  Can an artist safely use or incorporate another’s work in a creative manner in his or her own work, or is there a clear trend in the courts to reject the fair use defense in such works in light of the Second Circuit’s March 26, 2021 decision in The Andy Warhol Foundation v. Goldsmith, and the Ninth Circuit’s recent decision in Dr. Seuss Enterprises, L.P. v. Comic Mix LLC?  And what effect will the Supreme Court’s April 5 decision in Google v. Oracle have on future fair use decisions?  Explore all of these questions and more with our esteemed panel --UCLA School of Law Professor Eugene Volokh and copyright litigators Louis P. Petrich of Ballard Spahr and Rachel Capoccia of Jeffer Mangels Butler & Mitchell, LLP – moderated by Tracy Rane of Kasowitz Benson Torres, as they help us navigate through the recent fair use cases and provide invaluable insight concerning the propriety and impact of the decisions.
